Terry vollbrecht new trial
The attorneys' motion, filed Friday in Sauk County Circuit Court, asked that custody of Vollbrecht be transferred to the Sauk County sheriff and added that the opportunity for a bail hearing should be considered. On Jan. Bauer ruled there were enough questions about Vollbrecht's guilt in the June death of year-old Angela Hackl near Sauk City to grant him a new trial. In his ruling, the judge pointed to a man convicted of a similar murder during the same period, Kim Brown of Adams County, as a potential alternative suspect.
In a motion filed Friday in Sauk County Circuit Court, Vollbrecht's Wisconsin Innocence Project attorneys argue he should be immediately released from the Wisconsin prison system and transferred to Sauk County's custody in anticipation of the trial. Vollbrecht has been imprisoned since his conviction in December He is presently held at the Stanley Correctional Institution in Stanley, according to records.
The attorneys argued that Vollbrecht also deserves the same pre-trial presumption of innocence as any other defendant, and as such should have a chance to. Vollbrecht remained in his home community while awaiting his first trial for approximately two years. As of Wednesday afternoon, court records show no trial date scheduled for Vollbrecht. The Wisconsin state prosecutors handling his case have not yet responded to the Innocence Project's motion.

She had been strung up with a tire chain from the trunk of her boyfriend's car, sexually assaulted and shot in the back three times. It appeared the killer had planned to burn the body. Vollbrecht told investigators he met Hackl at the bar. He said they drove to the woods and had consensual sex on a sleeping bag, and Hackl then drove him back to Sauk City.
But several people who knew him and were in the area where he said Hackl dropped him off told detectives they never saw him. The day after Hackl disappeared, Vollbrecht told his hairstylist he didn't do it or if he did, he didn't remember. Prosecutors contended that Vollbrecht sexually assaulted and killed Hackl after she resisted his advances. He was convicted of first-degree murder and first-degree sexual assault in December A state appeals court has twice upheld his convictions.
